TERMS & CONDITIONS

1. Promotion:
Now That’s a Tasty Offer - Slices Promotion 2021

2. The Promoter:
The Promoter is Fonterra Brands (Australia) Pty Ltd of Level 2, 40 River Boulevard Richmond 3121 Australia, (ABN 80 095 181 669) (“Promoter”).

3. Purchase Period:
3.1 Purchase Period commences 12:01am AEST 3 May 2021.
3.2 Purchase Period concludes 11:59pm AEST 30 June 2021.

4. Claim Period:
4.1 Claim Period commences 12:01am AEST 3 May 2021.
4.2 Claim Period concludes 11:59pm AEST 30 June 2021.

5. Relevant Locations:
Australia

6. Eligible Businesses:
Claims are open to all Australian food service businesses, with a direct supply agreement with an Approved Distributor (PFD, Bidfood, Countrywide, NAFDA and approved independent distributors) who have purchased from the Approved Distributor in one (1) transaction of at least $100 (excluding GST) of Eligible Products (“Eligible Business”).

8. Reward:
$20 Fonterra Digital Gift Card or Prepaid Eftpos gift card. Eligible Businesses may select one (1) reward (“Reward”) when they make a valid claim.

9. Claims:
9.1 Only an Eligible Business may make a claim. Eligible Businesses must only appoint individuals aged 18 years or older who are residents of Australia, excluding management, employees and contractors of the Promoter, its associated companies/subsidiaries, Approved Distributors and agencies (and their immediate family members) associated with this Promotion, to make a claim on behalf of the Eligible Business.

9.2 The first one thousand (1,000) valid claims received will each be awarded with a $20 Cashback (choice of Fonterra Digital Gift Card or Prepaid Eftpos gift card). Each Eligible Business may make a maximum of four (4) claims under this Promotion. Each claim must be accompanied by a separate proof of purchase. For the avoidance of doubt, even if the proof of purchase indicates more than a $100 purchase of Eligible Products, only a single claim may be made on that proof of purchase.

9.3 Claims will be deemed to be accepted at the time of receipt into the Promoter’s database, and not at the time of transmission.

9.4 The total value of the gift pool is $20,000. Gifts will be awarded on a first valid claim basis.

10. How to Participate:
10.1 During the Purchase Period, purchase for immediate delivery of in-stock products (and without returning the same or requesting a refund or credit) any Eligible Product from an Approved Distributor (“Qualifying Purchase”).

10.2 Retain a copy of the purchase receipt from the Qualifying Purchase.

10.3 During the Purchase Period, visit www.anchorfppromotion.com and follow the prompts to the online claim form.

10.4 Complete and submit the online claim form, providing all details required, including but not limited to:
(a) selection of the desired (1) Reward
(b) information about the Eligible Product and Qualifying Purchase (including information about the product purchased, place of purchase, purchase date, purchase price, etc);
(c) a copy of the purchase receipt from the Qualifying Purchase (“Qualifying Purchase Receipt”) in an accepted file size/format containing the following information:
(i) the Eligible Product purchased;
(ii) the Approved Distributor of purchase;
(iiii) the purchase date; and
(iv) the receipt number
(d) any requested personal information (including but not limited to, name, phone number, email address, date of birth and delivery address); and
(e) indicate acceptance of these Terms and Conditions

10.5 Within 3 days of the submission of a claim, the Eligible Business will receive notification via email or text message confirming:
(a) that the claim has been successful, and that a Reward will be issued; or
(b) that the claim has not been successful as the pool of Rewards has been exhausted; or
(c) that the claim has not been successful as it could not be validated or information was provided incorrectly, in which case the Promoter will provide the reason for the defect and the opportunity to correct the claim within 7 days. However, the Promoter makes no warranty or representation that even if a corrected claim is subsequently made, that the Reward pool will not be exhausted.

10.6 If a claim is successful, the Reward will be issued as follows:
(a) Fonterra Digital Gift Cards will be sent to the Eligible Business’s email address and mobile phone number nominated on the online claim form. Eligible Businesses must then follow the prompts to activate the Fonterra Digital Gift Card by the specified dates. The Fonterra Digital Gift Card is subject to the terms and conditions at https://truerewards.com.au/terms-and-conditions.
(b) Prepaid Eftpos gift cards will be sent to the Eligible Business’s delivery address nominated on the online claim form. Cards will be sent via standard post within fourteen (14) business days of confirmation of the claim being approved. Eligible Businesses must then follow the instructions accompanying the Prepaid Eftpos gift card in order to activate and use the card by the specified dates. 11. General Conditions:
11.1 Participation in this Promotion is deemed acceptance of these Terms and Conditions. The Promoter’s decision not to enforce a specific restriction does not constitute a waiver of that restriction or of these Terms and Conditions generally.

11.2 The Promoter’s decision in relation to any aspect of these Term and Conditions and the Promotion is final and binding on every person who participates. No correspondence will be entered into.

11.3 This Promotion is not valid in conjunction with any other offer.

11.4 Any values stated in these Terms and Conditions are in AUD including GST and represent the recommended retail price.

11.5 The Promotion may be shortened or extended at the Promoter's absolute discretion.

11.6 participants may only participate in the Promotion in their own name. Participants who enter using aliases (e.g. multiple names, addresses and/or email addresses) will be disqualified.

11.7 All participants acknowledge that the Promoter can rely on these Terms and Conditions even if the Promoter only learns of a person’s ineligibility after the Promoter has awarded a Reward to the ineligible person. Payment of the Reward value to the Promoter may be required by the participant if this occurs.

11.8 Incomplete, indecipherable or incorrect claims will be deemed invalid. Participants are responsible for ensuring their correct personal details are provided and any updated details are notified to the Promoter. The Promoter accepts no responsibility should an Eligible participant fail to receive their Reward because of a failure to notify the Promoter of correct details or of a change to their details, or for providing invalid information.

11.9 The Promoter does not warrant that the claim mechanism will be available at all times during the Promotion Period.

11.10 The Promoter is not responsible for any undelivered entries.

11.11 The Promoter shall not be liable for a Reward being lost, deleted, stolen, damaged or tampered with in any way before it reaches a participant or after it has been released to a participant.

11.12 Any costs associated with accessing the Promotion or Reward provider’s website or associated with redeeming a Reward are the participant’s responsibility and are dependent on the internet service provider used. Participants must submit their claim manually using a compatible internet browser. The use of any automated software or any other mechanical or electronic means that allows a participant to automatically submit claims in the Promotion repeatedly is prohibited and will render all claims submitted using such means invalid.

11.13 The Promoter may, in its sole discretion, declare any claim or participant invalid if the participant:
(a) tampers, disrupts, annoys, abuses, threatens, harasses or attempts to do any of these things to the Promoter, another participant or potential participant of, or anyone else associated with, this Promotion;
(b) submits a claim that is not in accordance with these Terms and Conditions; or
(c) engages in conduct in relation to this Promotion which is misleading, deceptive, fraudulent or damaging to the Promoter's goodwill or reputation.

11.14 If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to modify, suspend, terminate or cancel the Promotion, as appropriate, subject to any directions from any relevant authority.

11.15 As a condition of claiming a Reward, the participant may be required to (at the Promoter’s discretion) sign any legal documentation as and in the form required by the Promoter and/or Reward suppliers in their absolute discretion.

11.16 The Promoter may communicate or advertise this Promotion via Facebook. However, the Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Participants are providing their information to the Promoter and not to Facebook. Each participant completely releases Facebook from any and all liability.

11.17 The Reward must be taken as offered and may not be varied. The Reward is not transferable, exchangeable, or redeemable for cash. If a Reward is unavailable for any reason, the Promoter reserves the right to substitute another Reward of equal or greater value for that Reward, or element of it, subject to the approval of any relevant authority.

11.18 Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following:
(a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
(b) any theft, unauthorised access or third-party interference;
(c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Reward value to that stated in these Terms and Conditions;
(e) any tax liability/implications incurred by a participant; or
(f) use of a Reward.

11.19 The:
(a) Promoter, the Promoter's related entities, the Approved Distributors and all agencies associated with the Promotion; and
(b) Employees, agents, directors and contractors, of all entities referred to in this clause, shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or acceptance of a Reward, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).

11.20 Participants must, at the Promoter's request, participate in any Promotion activity (such as publicity and photography) relating to participating in the Promotion, free of charge, and they consent to the Promoter using their name and image in any future promotional material.

12. Personal Information:
12.1 Immediately upon submission by a participant, their entry and claim become the sole property of the Promoter.

12.2 All information participants provide (“Personal Information”) will be used by the Promoter for the purpose of administering this Promotion and the Reward.

12.3 The Promoter may disclose participants' Personal Information to its contractors and agents to assist in conducting this Promotion and as required, to Australian regulatory authorities.

13. Promoter Opt-In:
13.1 If a participant consents to receiving future information from the Promoter, information provided by the participant may be entered into a database and used by the Promoter, the Promoter's related entities and agencies engaged by the Promoter, for the Promoter's current and future promotional and marketing purposes without further reference or compensation to them.

13.2 If a participant who elects to opt in wish to opt out or access or update their information held by the Promoter at any time, they can contact the Promoter as set out in its privacy policy at: https://www.fonterra.com/nz/en/privacy-statement.html

13.3 The Privacy Policy contains information on:
(a) how a participant may access the Personal Information that is held by the Promoter and seek correction of such information; and
(b) how a participant may complain about a breach of the Australian Privacy Principles, or a registered privacy code that binds the Promoter, and how the Promoter will deal with such a complaint.
(c) If a participant has any questions regarding their privacy, they should contact the Promoter using the contact details contained in this Privacy Policy.

13.4 The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988.

14. Limitation of Liability
The Promoter’s liability is limited to the value of a single Reward. Neither the Promoter including its officers, employees and agents) nor a participant shall be liable to the other for any indirect, consequential, exemplary, special or punitive loss or damage suffered or incurred by the other pursuant to these Terms and Conditions or in connection with the Promotion.
